Baby Reunion Video Submission Terms and Conditions

 

Introduction This opportunity is organized by Frank D. Yelian, MD PC, doing business as Life IVF Center and/or Life IVF Center Los Angeles (hereinafter referred to together as the “Clinic”). Individuals submitting videos under this opportunity are referred to as “Participants.” By participating in this opportunity, you agree to comply with these terms and conditions. Please read them carefully.

Eligibility

  1. Participation is open to individuals who have received treatment at the Clinic and wish to share their success stories.

  2. Individuals submitting videos must be 18 years of age or older. If minors (e.g., children or dependents) appear in the testimonial videos, their inclusion is subject to the Parental Consent for Minors section below.

  3. Employees, contractors, and affiliates of the Clinic and their immediate families are not eligible to participate.

  4. Void where prohibited. Participants are responsible for ensuring their eligibility under local laws, including any restrictions on entering or receiving prizes.

Submission Guidelines

  1. Videos must be original and feature the participant’s testimonial regarding their experience with the Clinic.

  2. If partners, children, or other individuals appear in the video, their consent must also be provided.

  3. Content must not contain offensive, discriminatory, or unlawful material.

  4. Videos must be submitted through the official submission portal provided on the Clinic’s website by the specified deadline.

Prizes

  1. A scholarship fund totaling at least $2,500 will be awarded to one or more participants. The final number of winners and the distribution of the scholarship will be determined based on the number and quality of submissions.

  2. The scholarship will be awarded to support the education or related needs of the participant’s child or children.

  3. The Clinic reserves the right to increase the total prize amount at its discretion.

Selection Process

  1. Submissions will be reviewed by a panel of staff members at the Clinic based on creativity, originality, storytelling, and the emotional impact of the testimonial.

  2. Selected participants will be notified via the contact information provided during submission.

  3. Winners may be required to sign an affidavit of eligibility and release before receiving the prize.

Privacy and Consent

  1. By submitting a testimonial video, participants consent to the Clinic’s use of their video, name, and likeness for promotional purposes, including on social media, websites, and marketing materials.

  2. The Clinic complies with the California Consumer Privacy Act (CCPA) and other applicable privacy laws. Personal information collected during this opportunity will be used solely for the purposes of administration and promotion and will not be sold to third parties.

  3. Participants featuring minors in their videos must ensure compliance with the Children’s Online Privacy Protection Act (COPPA) by providing verifiable parental or guardian consent to the Clinic.

Parental Consent for Minors

  1. If a submitted video features minors (children under the age of 18), the parent or legal guardian submitting the video agrees to the following:
    a. They are the parent or legal guardian of the minor(s) featured in the video.
    b. They grant explicit consent for the minor(s) to appear in the video and for their likeness, voice, and other personal identifiers to be used in accordance with these terms and conditions.
    c. They understand and agree that the Clinic may use the video, including the minor(s)’ appearance, for promotional purposes, including marketing materials, websites, and social media.

  2. The parent or legal guardian also agrees to indemnify and hold harmless the Clinic for any claims arising from the inclusion of the minor(s) in the video submission.

HIPAA Disclaimer

  1. By submitting a testimonial video, Participants acknowledge that they are voluntarily sharing their personal experience and any related health information. The Clinic will not disclose or share participants’ protected health information (PHI) without explicit authorization, in accordance with the Health Insurance Portability and Accountability Act (HIPAA).

  2. Any health-related information shared by participants in their video submissions is at their discretion and does not constitute a HIPAA-regulated disclosure by the Clinic.

Publicity Release

  1. By participating, Participants grant the Clinic permission to use their submitted videos, names, likenesses, and testimonials in any promotional or marketing efforts without further consent or compensation.

  2. Participants waive any rights to inspect or approve the final promotional materials.

Right to Disqualify

  1. The Clinic reserves the right to disqualify any submission that violates these terms and conditions, includes offensive content, or fails to meet the submission guidelines.

Force Majeure

  1. The Clinic shall not be held liable for delays, interruptions, or cancellations caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, or technical failures.

Intellectual Property

  1. By submitting a video, participants grant the Clinic a perpetual, royalty-free, worldwide license to use, modify, reproduce, and distribute the submission in any medium.

  2. Participants retain ownership of their content but agree that the Clinic may use it without restriction or additional compensation.

Limitation of Liability

  1. The Clinic is not responsible for: a. Technical failures, including but not limited to hardware or software malfunctions, lost or unavailable network connections, or failed, incomplete, or delayed computer transmissions. b. Any incorrect or inaccurate information caused by website users, tampering, hacking, or any equipment or programming associated with or utilized in the submission process. c. Any injury, loss, or damage of any kind arising from or in connection with participation in the opportunity or the use of submitted content by the Clinic.

  2. By participating, Participants agree to: a. Release, discharge, and hold harmless the Clinic, its employees, affiliates, agents, and assigns from any and all liability for claims, damages, or losses, including but not limited to personal injury, property damage, or loss of data, that may occur in connection with their participation or use of the submitted content by the Clinic. b. Assume full responsibility for any costs, injuries, or damages incurred as a result of their participation or any claims related to the submitted content.

  3. The Clinic does not assume responsibility for any unauthorized access to or use of personal information submitted by Participants, except as required under applicable privacy laws.

Severability

  1. If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

General Terms

  1. The Clinic reserves the right to modify or terminate this opportunity at any time without prior notice.

  2. Any disputes arising from these terms and conditions will be governed by the laws of the State of California.
